Changing an application or existing approval

You can apply to make a change to your development application before Council decides the application.  You can also apply to change an existing development approval.

Type of change request

There are two types of changes under the Planning Act 2016:

Minor change – does not result in substantially different development (see below) and does not cause referral (where there was not already a referral) or additional referral to a referral agency or public notification (if notification was not already required).

A minor change does not affect the development assessment process and the application continues to be assessed as if the change material was part of the original application.

Depending on the stage of the application, impact-assessable applications may need to repeat the public notification process.

Other change – changes that are not considered minor changes. An ‘other’ change will cause the assessment process to stop and recommence at the lodgement stage. Anyone involved in the assessment, including referral agencies, may make an information request or change their initial response to the application. The process will not stop if the change:

  • only deals with a matter raised in a properly made submission
  • is in response to a request for further information or
  • is in response to further advice provided by Council.

If public notification was not originally required but the change results in the requirement for it to be undertaken, it must be completed before Council can continue assessing the application.

Substantially different development

The Development Assessment Rules made under the Planning Act 2016 define substantially different development. A change may be considered to result in a substantially different development if any of the following apply to the proposed change:

  • involves a new use; or
  • results in the development application applying to a new parcel of land; or
  • dramatically changes the built form in terms of scale, bulk and appearance; or
  • changes the ability of the proposed development to operate as intended; or
  • removes a component that is integral to the operation of the development; or
  • significantly impacts on traffic flow and the transport network, such as increasing traffic to the site; or
  • introduces new impacts or increases the severity of known impacts; or
  • removes an incentive or offset component that would have balanced a negative impact of the development; or
  • impacts on infrastructure provisions.

Making a change request

To apply for a change, your request must include:

  • A completed change request application form (Queensland Government, search 'Form 5')
  • Evidence of the level of change being requested
  • Relevant supporting documentation, which may include new site plans, elevations and technical reports
  • Pre-request response notice (if applicable)
  • Owners consent if required
  • Proof of referral to any relevant referral agencies
  • Applicable Council fee for the level of change (refer to Council's register of fees).
