In accordance with Section 22 of the State Penalties Enforcement Act 1999, the alleged offender must, within 28 days after the date of the infringement notice:
- pay the fine in full
- make an election to have the matter of the offence decided in a Magistrates Court
- if applicable, give an illegal user declaration, a known or unknown user declaration or a sold vehicle declaration for the vehicle for the offence
Please note that you cannot elect for the matter to be heard by a Magistrates Court if more than 28 days have passed since receipt of the initial notice or if the infringement has been paid.
Before making the decision to have your penalty infringement notice determined by a Magistrates Court, please consider that the court has the power to award costs against you if you are unsuccessful.
The outcome could include an increase to the original infringement notice, as well as costs incurred by Redland City Council such as:
- Court lodgement fee
- Vehicle registration search (vehicle related only)
- Registered mail cost
- Professional fees
